"We received a concern about a possible ineligibility issue, we did an inquiry with the school and they checked into it," said WVSSAC executive director Gary Ray. "It was determined with cooperation of the school and this office that they had an ineligible student participating." The Tigers have won seven games on the season and enter the week ranked No. 8 in Class AAA. The loss of all of their wins will cause a ripple down effect in both the Class AAA and AA rankings. "I'll put it this way, as we told them," Ray said. "Any games this athlete participated in must be forfeited. And, of course, if he participated in all the games they won, then they would forfeit all their games." Ray said the accusations came to the WVSSAC office recently, though he wouldn't specify who made the claim against Elkins. "I won't say because that wouldn't serve any purpose," Ray said. "But it was brought to our attention and anytime something is brought to us in writing, we feel we need to address it." Ray said he talked with Elkins' school officials on the matter early Wednesday morning. The Tigers have wins this season over Oak Hill, Hampshire, Buckhannon-Upshur, Preston, Fairmont Senoir, Philip Barbour and East Fairmont. The kid transferred in under the federal homeless kid law and SHOULD be eligible, but the WVSSAC's rules weren't changed. Since it IS the WVSSAC, this is going to court. It's pretty stupid that the parent of a player at a rival school sent a letter bringing this kid into question. Monday, October 29 2012 WVSSAC Release on Elkins Situation MetroNews Sports WVSSAC RELEASE -- This office received an inquiry concerning the eligibility of a football player who is a student at Elkins High School. In accordance with our normal procedure, this office referred the matter to the administration of Elkins High School. The school investigated the situation, and initially it was determined that the student athlete was ineligible under the rules of the WVSSAC. Then the Randolph County Board of Education intervened, reviewed all of the facts and determined that under federal law the student in question is eligible for interscholastic athletic competition. At the request of this office, the West Virginia State Board of Education reviewed the federal law cited by the Randolph County Superintendent, and concluded that under these particular facts and circumstances of this case, the student athlete in question is eligible for interscholastic athletic competition in West Virginia because of federal law. Accordingly, the student athlete in question is eligible. Elkins High School will not be required to forfeit any football games. Gary Ray, Executive Director said, “It is our hope that this will bring closure to the eligibility issue regarding a student athlete at Elkins High School”.
